My name was put on a title of a house that my husband bought. Can I remove it somehow???
The mortgage is not in my name just when he titled it. I need to remove it. I live in Arkansas if anyone can tell me what to do. I heard someone say something about a document you can buy at an office store called a quitclaim.
A “Quitclaim” deed is a document wherein a person gives up, or “quits” any right or title that they may have to a specific piece of real property. It needs to be signed in front of a Notary Public and then recorded in the county where the property is situated.
This will remove your name from any right to ownership of the property. I did not understand what you said about the mortgage. A quitclaim deed will not remove you from the mortgage if you are on that, and normally you cannot be removed from a mortgage unless the property is refinanced or sold.
Your state’s community property rules will govern any liabilities you may or may not have as to any marital property issues. If the house was purchased by your husband before your marriage and he then added your name to the title, the house may still be his separate property. If it was purchased during your marriage with community property funds, then most likely taking your name off of the title will have no effect. The rules as to these issues vary from state to state.
